Complete Form 230 by May 27.
Individuals can redirect 3.5% of their income tax to the MICUL ZEN Association until May 27!
How much do you spend? NOTHING! This amount represents a part of the State Budget collected from your income in the previous fiscal year, namely 2023. This amount does not represent a private donation and will NOT COST YOU ANYTHING. If you don’t want to remit the 3.5% of income tax, it will go entirely to the state.
Fill in form 230 with your personal data and sign it by May 27. We take care of the rest. We will send the form to ANAF by the deadline, so that 3.5% of your income tax is automatically redirected to the MICUL ZEN Association.
According to Order 1679/2022, deductible sponsorships from corporate income tax or micro-enterprise income tax can be made within 6 months from the legal deadline for filing the annual corporate income tax return or the micro-enterprise income tax return for the fourth quarter.
Therefore, if you made deductible sponsorships in 2023 but did not reach the maximum ceiling established by law (maximum 20% of corporate income tax, but no more than 0.75% of turnover), you have the possibility to submit, by December 25, 2024, to the ANAF, declaration 177, requesting that the remaining unallocated sponsorship difference up to the maximum ceiling be redirected to our projects.
The same declaration can be submitted by companies that have not made any deductible sponsorships from income tax (corporate income tax or profit) for the year 2023.
The procedure is simple: a sponsorship contract is signed between the company and the Association, specifying the exact amount, as derived from accounting calculations, the declaration 177 is completed for the same amount, and submitted to the ANAF. From that moment on, the ANAF has 45 days to process and transfer the amount to us.
Expenses related to sponsorship are deductible from corporate income tax, up to 20% of it, but not more than 7.5‰ (per mille) of the turnover. The remaining 80% of the tax due will be transferred to the state budget, according to the terms provided by the fiscal code. Sponsorship expenses can be deducted quarterly (for example, sponsorships paid until March 30th can be deducted, within the specified limits, from the tax due by April 25) or annually (sponsorships made during a fiscal year will be deducted, within legal limits, from the tax due by March 25 of the following year).
Sole traders can incur sponsorship expenses, deductible up to 5% of net income, determined as the difference between gross income and deductible expenses, excluding sponsorship expenses.
Commercial companies subject to income tax that make sponsorships, according to the provisions of Law no. 32/1994, to support non-profit entities and religious units, which at the date of concluding the contract are registered in the Register of Entities/Units of Worship eligible for tax deductions under Article 25 paragraph (4^1), deduct the corresponding amounts from income tax up to the value representing 20% of the income tax due for the quarter in which they recorded the respective expenses. The remaining 80% of the tax due will be transferred to the state budget at the deadlines provided by the tax code. For income tax, sponsorships can only be deducted quarterly (for example, sponsorships made by March 30th can be deducted, within the specified limits, from the tax due by April 25th). For these companies, sponsorships cannot be made annually for all previous quarters.
